Phase 1 Environmental Site Assessments (Phase 1 ESA)
A Phase 1 ESA provides an independent professional opinion about the environmental condition of real estate property. A Phase I ESA evaluates the historical use of the property and neighboring sites and determines if there is actual or potential environmental contamination on the site or the potential for such materials to be released onto or from the site. A Phase I ESA is conducted when purchasing commercial and industrial property. A Phase 1 ESA is often also conducted prior to starting a new residential development, or when acquiring undeveloped vacant land. Lenders often conduct Phase I ESAs as part of their risk management practices - to determine whether there may be environmental issues present that could cause a borrower financial hardship, and result in a reduced value of the property due to contamination. Conducting a Phase 1 ESA may impact a claim to the “innocent land owner” exemption after property acquisition.

California Environmental Quality Act (CEQA) Document Preparation
CEQA is environmental law that applies to projects of all California state, regional or local agencies, but not to Federal agencies. Its purposes include ensuring informed governmental decisions, identifying ways to avoid or reduce environmental damage through feasible mitigation or project alternatives, and providing for public disclosure . It includes the preparation of documents such as Initial Studies (IS), Mitigated Negative Declarations (MND), Categorical Exclusions (CE), and Environmental Impact Reports (EIR).

Storm Water Pollution Prevention Plan (SWPPP) Preparation
If your project's total surface area of disturbance exceeds one acre, or is part of another common plan of development (e.g., phased development), your project may be required to obtain coverage under the Construction General Permit (Order No. 2009-0009-DWQ) prior to any construction activity. If your project is under one acre, you may be required to prepare a Water Pollution Control Program (WPCP).
